What does it take for an individual to be personally responsible for behaviors that lead to increased risk of disease? We examine three approaches to responsibility that cover the most important aspects of the discussion of responsibility and spell out what it takes, according to each of them, to be responsible for behaviors leading to increased risk of disease. We show that only what we call the causal approach can adequately accommodate widely shared intuitions to the effect that certain causal (...) influences—such as genetic make-up or certain social circumstances—diminish, or undermine personal responsibility. However, accepting the causal approach most likely makes personal responsibility impossible. We therefore need either to reject these widely shared intuitions about what counts as responsibility-softening or undermining or to accept that personal responsibility for behaviors leading to increased risk of disease rests on premises so shaky that personal responsibility is probably impossible. Walter Fisher's narrative paradigm has sparked intense debate about the role of narratives in rhetorical scholarship. The theory has subsequently been followed up by numerous criticisms and revisions. This article argues that especially the latter can benefit from a complementary phenomenological perspective that Fisher himself placed within the original paradigm. Through the Heideggerian concepts of building and dwelling, rhetoric within the narrative paradigm may be seen as a primary means for engaging with both individual and communal goals and exigencies, providing (...) a more nuanced account for how people care for and act on the narratives in their lives. Internal due process systems are the formal mechanisms thatmany organizations use to address and resolve ethics conflicts.Problematical due process systems such asinvestigation-punishment and grievance-arbitration systemsnarrowly constrain the political and moral space needed formeaningful ethics voice, praxis, and community. The relativelyuncommon employee board and mediator-counselor types of systemscan help solve such problems. The employee board andmediator-counselor systems permit questioning not only of guiltwith respect to policy violations but also the appropriateness ofthe policies as well as potential biases in an organization'sembedded tradition-system (...) that may be contributing to unethicalbehavior. Theoretical implications for organization ethics,praxis, community, and integrative social contracts theories areexplored. Several case examples are discussed. (shrink)

Torbjörn Tännsjö has written a clear and thought-provoking book on healthcare priority setting. He argues that different branches of ethical theory—utilitarianism, egalitarianism, and prioritarianism—are in general agreement on real-world healthcare priorities, and that it is human irrationality that stands in the way of complying with their recommendations. While I am generally sympathetic to the overall project and line of argumentation taken by the book, this paper raises two concerns with Tännsjö’s argument. First, that he is wrong to set aside deontic (...) constraints as irrelevant or as pointing in the same direction as consequentialism. Secondly, that his argument against prioritarianism in favor of utilitarianism is insufficient and under-developed. Given these problems, I conclude that we should welcome Tännsjö’s contribution but with these qualifications in mind. (shrink)

Over recent decades, public participation in technology assessment has spread internationally as an attempt to overcome or prevent societal conflicts over controversial technologies. One outcome of this new surge in public consultation initiatives has been the increased use of participatory consensus conferences in a number of countries. Existing evaluations of consensus conferences tend to focus on the modes of organization, as well as the outcomes, both procedural and substantial, of the conferences they examine. Such evaluations seem to rest on the (...) assumption that this type of procedure has universally agreed goals and meanings, and that therefore consensus conferences can readily be interpreted and applied across national boundaries. This article challenges this approach to consensus conferences. The core of the article is a study of national differences in ideas about what constitutes legitimate goals for participatory arrangements. The study looks at three consensus conferences on GMOs, which took place in France, Norway, and Denmark. Drawing on this study, the article discusses the ways in which interpretations of the concept of participation; the value attributed to lay knowledge vs. technical expertise; as well as ideas about the role of the layperson, are all questions that prompt entirely different answers from country to country. Further, the article analyses these national differences within a theoretical framework of notions of democratic legitimacy. (shrink)

The main public health advantages of examining gene by environment interactions in externalizing behavior lie in the realm of personalized interventions. Nevertheless, the incorporation of genetic data in randomized controlled trials is fraught with difficulties and raises ethical questions. This paper has been written from the perspective of developmental psychologists who, as researchers, see themselves confronted with important and in part new kinds of ethical questions arising from G × E research in social sciences. The aim is to explicate and (...) discuss ethical questions, based on the conviction that what is ethically salient in a research setting will also be relevant in that area of public healthcare incorporating research findings. The ethical questions discussed include: whether it is ethically responsible to withhold an effective treatment; to what extent genetic results should be disclosed; whether researchers should be allowed to collect genetic data of both child and parent; and what are costs and benefits of personalized interventions based on screening. We made an attempt to address these questions, but it is up to researchers to determine whether the solutions are suitable for their G × E research in social sciences. (shrink)

Multi-method research is any research that uses more than one research technique or strategy to study one or several closely related phenomena. This method is described by triangulation. This article examines the multi-method tradition in empirical legal research, defines basic concepts, discusses when and why multi-method research is useful, and how the different actions of research can provide unique approaches to the same questions. It explores examples of projects to demonstrate how research that employs multiple tactics for observing and understanding (...) is more reliable than a single study if the studies are of comparable quality. At the same time, multi-method research comes with great costs and risks that must be considered at the outset of such a project as well as during the project itself. However, it is speculated that multi-method research is perhaps the most effective way to understand the relationship between law and society. (shrink)

That PTSD nightmares are highly realistic threat simulations triggered by trauma is difficult to reconcile with the disturbed, sometimes debilitating sleep and waking functioning of PTSD sufferers. A theory that accounts for fundamental forms of imagery other than threat scenarios could explain the selection of many more adaptive human functions – some still pertinent to survival today. Conceptual relativism is characterized and elucitated in such a way that its force can be appreciated. It is argued that the usual attempts to dismiss it as a conceptual confusion fail. Then two attempts to articulate a conception of rationality adequate to show how conceptual relativism rests on a mistake are examined and shown to be at the best only partially successful. The upshot is, that, counter-intuitive as it is, the problem of conceptual relativism is still very much with us.

Conservative criticisms of egalitarianism are examined. Entitlement and desert based accounts of justice are assessed. Nisbet's, Nozick's and Flew's accounts, as paradigms of conservative views, are criticized and liberal egalitarian and radical egalitarian accounts of justice, in their responses to conservatism, are contrasted and a defense is provided for radical egalitarianism. A secure place for entitlements is found within an egalitarian frame work. Liberty and equality are shown to be so reciprocally related that one cannot flourish without the other and (...) socialism and egalitarianism are shown not to be enemies of liberty. Personal property remains intact under socialism but private productive property does not. But the non-existence of the latter is perfectly compatible with the existence of the full range of basic liberties. Following a coherentist methodology respect for entitlements, for liberty and a commitment to equality are shown to be in reflective equilibrium. (shrink)

Beginning with a review the logically first stages in the project of Random Dynamics, hoping for all laws nature being emergent, we also review what can be considered a consequence of Random Dynamics, a model—by myself and Masao Ninomiya—, which in principle predicts the initial conditions in such a way as to minimize a certain functional of the history of the Universe through both past and future. This functional is indeed the imaginary part of the action, which exists (only) in (...) our model of complex action. The main point of the present is to suggest this complex action model to be also helpfull in solving some problems for quantum mechanics. Especially as our model almost makes it possible in principle to calculate the full history of the universe, it even makes it in principle calculable, which one among several measurement results in a quantum experiment will actually be realized!Our “complex action model” thus is a special case of superdeterminism—in Bells way—and does not have true causality, but rather even in some cases true backward causation. In fact we claim in our model that the SSC(Superconducting Supercollider) were stopped by the US Congress due to the backward causation from the big amounts of Higgs particles, which it would have produced, if it had been allowed to run. The noumenon (“das Ding an sich”) in our model is the Feyman path integrand or better some fundamental quantities determined from second order effects of the latter integrand. The quantum mechanics interpretation here is strongly similar to the much criticized “transactional interpretation” by John Cramer (Rev. Mod. Phys. 58:647–688, 1986), but we might respond to some of the criticism. (shrink)
